Welcome to PadsPass®!
These Master Terms of Service ("Terms" or "MToS") form a legally binding agreement between you ("User") and PadsPass, Inc. ("PadsPass", "we", "us"), a Delaware corporation. They govern your use of all PadsPass products and services, including but not limited to the PadsPass website, Digital Pet Passport℠, VIPP℠, Pet ID, Teledevice/Telehealth, and any future features ("Services").
By accessing or using any PadsPass Service, you agree to these Terms, our Privacy Policy, and all Service-Specific Terms and Addenda. If you disagree, please refrain from using the Services.
1. Agreement Structure & Hierarchy
- These Master Terms apply to all PadsPass Services and Users worldwide.
- Service-specific terms (for VIPP, Digital Pet Passport, Microchip Database, Teledevice, etc.) are incorporated by reference and prevail in the event of any conflict.
- Privacy Policy and Jurisdictional Addenda (e.g., GDPR, Bermuda PIPA, CCPA/CalOPPA) are integral to this agreement.
2. User Eligibility & Accounts
- You must be 18+ and provide accurate, complete information.
- Account access is restricted to eligible pet owners, veterinarians, authorized agencies, or their legal representatives (as detailed in Service Terms).
- You are responsible for safeguarding your credentials. Notify us of any unauthorized use.
3. Fees, Subscriptions, and Refunds
- Fees for each service/product line are detailed in the relevant Service-Specific Terms and PadsPass website.
- Payments are in U.S. Dollars unless otherwise stated.
- Refunds:
- 7-day "cooling-off" period for new subscriptions
- Pro-rata refund, pause, or donation option for "final journey" in single-pet households
- Otherwise, non-refundable except as expressly provided
4. Modifications, Termination, and Force Majeure
- PadsPass may modify, suspend, or discontinue any Service with at least 30 days' notice (except for urgent legal/security reasons).
- Force Majeure: PadsPass is not liable for delay/failure due to events outside reasonable control (pandemic, disaster, cyberattack, etc.); users notified within 72 hours; SLAs are suspended during such periods.
- Upon service termination, users have a reasonable period to export data before deletion.
